I think it is a scam. Why would apple let this guy use itunes. Who is he anyway. If they did give it to him they regret it now.

Why would Apple want to put it on a device that could possibly eat into iPod sales? Apple doesn't seem open (no pun intended) to sync it's songs and iTunes purchases to anything but an iPod or iTunes phone.
Furthermore, the carriers don't want Apple impeding on their revenue sources by allowing direct to phone downloads. In addition, Jobs just mentioned that he thought mobile purchases would as yet be very desireable by the public,

It makes perfect sense to have I-Tunes available for windows mobile. (why not? they put it on regular windows already!)

If this is an independent software developer trying to make it big, he'll only have a moment in time before Apple is all over him like white on rice.
It's real dubious at best that this is a true Apple creation, especially after what was done (or not done depending how you look at it) with the ROKR.

I do know that exacto software has something very similiar looking called wiFi Tunes. One of two things can be possible: 1) it is a fake and it's wiFi tunes dressed up in photoshop, or 2) it is real and and won't be around too long once Apple's legal dept get's wind of it (similar to pPod).
