Microsoft threatens legal repercussions against Dave's iPAQ


I have been putting this article off for many reasons which I would not like to disclose but just recently I thought it was of importance. On January 6th 2005 we posted screenshots of Microsoft's soon to be announced new OS from the site Neowin.net. During this time our site got linked from the famous Slashdot.org website which created a tremendous amount of curiosity from readers who would like to see it. On January 7th I received an email from Microsoft's Internet Antipiracy team requesting I pull the entire story. In the letter enclosed it did state if I did not pull the story there would be legal repercussions involved. Since I wasn't sure if this was a legit document I requested from the attorney's to call me directly. Within one hour I received a call from them telling me that it would be beneficial for me to pull it. After speaking with them I pulled the story from our site.

Over the next week, I had noticed other sites posting the images and story in which I reached out again to Microsoft asking if I could repost the story. It was re-iterated that I do not and that if I were to they would proceed with the next steps. One site that stood up to Microsoft was Engadget.com. Engadget is one of my favorite sites and was following the case through Engadget's communication through his website. Since Engadget has some relationship's within Microsoft he was able to contact Robert Scoble who works at Microsoft was introducing Engadget to the folks in the Mobile group so they could work out whatever their issue article that Engadget cut a deal with Microsoft to keep the story up.

On January 27th I requested to speak directly to Microsoft about my letter in which I was told by the attorney in England he would relay the message and have someone contact me. On January 28th I received a call from one of Microsoft's Attorneys is Redmond, WA explaining to me why the story needed to be pulled. I told her I don't think I have an issue on why the story needed to be pulled but more on how this issue has been handled. Some of my questions were

1) The letter I received was extremely harsh and threatening. It spoke about copyright infringements and distribution of copyrighted software.

2) Why was it ok for Engadget to keep the image and story up?

I told her that if that is the case then Microsoft is selectively discriminating my site since I do not have a relationship with Microsoft and that if you enforce it for one it has to be enforced for all! Also if it wasn't too compelling why did they send him the letter originally?


3) Why is Microsoft posting PowerPoint presentations on their site with information that unveils Windows Mobile 2005 information. but then threatening my site for posting my story?

As hopefully all of you can understand I feel very strong about this issue. My site was targeted and threatened to be shutdown with legal repercussions by Microsoft. For the past 5 years this site has done nothing but promote Microsoft's products at my own financial expense! I have spent many hours outside of my fulltime job evangelizing this platform for what? To be threatened and bullied? I don't think so Microsoft! Maybe a good suggestion is to pick up the phone and talk to me first before you threaten my community!

In conclusion Microsoft I would appreciate it that someone pickup the phone a contact me directly to resolve this.

i think i speak for most people here in saying that this site is a fantastic resourse not only for microsoft but for other companies aswell, i mean dave practically provides free advertising i dont think it is a crime to read in to a new product, i mean did we still the source code? Did we offer 'free' copies of windows mobile 05'? we only offered information and as far as i can see i dont see the crime in that and i am sure people agree with me?
All - MS probably get ,000s of these a day - I would not be surprised if they have a bot running to locate candidate comppormises of their IP, Trademark etc. This is the state of the world. As Dave reports, it was a generic letter - probably because they do not have the time to discriminate one shark from an evangelist. Dave I do believe given your dedication to the platform MS really should apologise and I would say provide some form of financial restition - if nothing else from the legal budget - else Marketing. Anyway nil illigitimus carborundum...and keep up the good work.

Seems like Microsoft are being very unfair to Dave. They have to show some consistency with issues like this and not have one rule for some and another for others.

stimey, you are not Dave and so would not know exactly what he heard. The glass is half full or half empty. We always seem to understand what we want to but reality is at times different. There is no need for flaming. I agree with you and jripaq that it is not right that some should get away with it. But then we should ask who are the thieves and bullies. Theft is theft. What is the point of the law (e.g. protection of intellectual property and trade secret) if it is not maintained. If you want anarchy then that is your perogative but I would prefer democracy and rule of law since that is that on which our society is founded on and permits you to have security, family safety and Internet access ... Spend a week in Iraq and then we can moralise more about MS trying to defend itself.
Zeus I have to agree with Stimey. Dave didn't steal ANYTHING? Dave posted an article that was on another site which he credited. I dont think he is mad that he had to pull it I think he is mad that other sites are still running it cuz they struck a deal with the bully. To me it sure sounds like discrimination.. SAD!

Dude you dont get Dave's point! If you read it you will understand that this site was singled out and threatened by MICROSOFT to shut it down. It looks like you are a newbie and just registered but I have been around for a long time and value this site and so should Microsoft! Also if you read the article why is engadget still running the article with photos??? HUH!
I think that you are all missing the point here. From what I can understand from all the stories floating around, a (legal) person's property was stolen. This person tried to protect themselves by trying to get it back (prevent spread and loss of R&D). Person called first, to be courteous, but with no response sent message. Now: if a thief stole your wallet and you asked him to give it back, and he then said NO, what would you do - Turn around and walk the other way? I doubt it. You would probably try and do whatever you could. We all need a rain check here. It is good to criticise but better to walk in another person's shoes before doing so. Not to threaten this site !! If you care to read and understand before pulling your gun out of it's holster, you would notice that there was NO threat. This is a great site and I always check it for g8 news but this one was cheap and that is why I registered. There are many great developments going on and it would be great to have the community building on positive developments.

As others have pointed out - they are getting FREE advertising here (amongst other places) and they pull a stunt like this.

It's not like we're distributing LONGHORN or anything. Oops - did I say that?!?
Good Point.. If they would let us all take a look at it we can probably identify the bugs and fixes so when they actually release the product it might be bug free. Although I do enjoy the product launches when Bill Gates gets the blue screen of death.
Here we are a community that embraces this technology and all Microsoft wants to do is alienate us.

I cant believe this. Dave for the past 5 years helps promote and sell Microsoft products and they take this stance? What are they nuts?
Better yet, since there are only parts of the Mobile 2005 story available everywhere, why can't they just come forward with LOTS of details and get everyone all excited about it? Build up interest, Free advertising, etc. Why hide the info? It is not like they have any real competition that would steal their ideas on the Pocket PC platform......

Just another example of playground tactics and the flexing of the billion-dollar muscle. While I can sort of see their (M$) position regarding the leaking/dissemination of information prematurely I don't see how they can ethically turn a blind eye (or keystroke) to another website doing the exact same thing. Are they in cahoots? Does M$ own/manage/control Engadget?
